1). Monitoring Extension Periods
• Remember, there is only six (6) months from the issuance of an NOA (Notice of Allowance) to file a “Statement of Use” or an “Extension of Time”.
2). Filing Extensions
• Under certain circumstances, we can file for an “Extension of Time” on your behalf for a maximum of five (5) extensions.
3). Supplying potential leads directly to you
• If you prefer, for a set fee per lead, we can forward any leads that we generate on behalf of your trademark directly to you; and if you make a deal yourself, you owe us nothing.
4). Negotiating on your behalf
• As leads come in with regards to your trademark, after qualifying the potential licensee, we will start the negotiation using the terms that you specified upon signing up with our service with the prospective licensee. We will pass along any counter offers by the prospective licensee for your approval or disapproval.
5). Contracting with Licensee
• Once negotiations and terms are agreed upon by all parties, we will furnish a contract that will represent the full agreement between you and the licensee, including, but not limited to: percent of royalties, schedule of royalty payments, minimum royalty payments to maintain license, time to launch from signing of the agreement, assurances from both parties, submission of promotional materials and packaging designs for approval prior to launch, and providing an acceptable sample that can be used as the specimen required to file a Statement of Use.
6). Monitoring Progress of Licensee
• Staying engaged with the licensee to see they are earnestly working towards launching on time or in an acceptable time frame and acquiring an acceptable specimen representative of the actual product to be introduced to the marketplace.
7). Filing Statement of Use
• The final step in turning a trademark application into a registered trademark. Once an acceptable specimen has been provided by the licensee, we will file an SOU on your behalf and inform you as well as the licensee when the registration has been granted so that all future promotional material can include the official “R in a circle” anytime the trademark name appears in print.
8). Collection and Disbursement of Royalties
• We can accept the royalty payments on your behalf and forward them along to an account of your choosing, less our agreed-upon commission.
9). Auditing of Sales
• Once a year, on your behalf, we can arrange for an independent accounting firm to undertake an audit of sales bearing the trademark name to ensure that you are getting the correct amount each quarter. This service is charged to your account prior to the audit taking place.
10). Monitoring of Registration Renewal Periods
• The USPTO requires all registered trademarks to be renewed every eight (8) or ten (10) years to ensure that the trademark is still viable and used in commerce. This requires the submission of a new specimen and proof that it is still being sold.
Failure to renew in a timely fashion will result in the cancellation of the registration.
